This document (Terms of Use) is intended to regulate the relationship between the users of the Revizion service and Trade House Ukraine LLC, as the title owner of the Revizion service, domain name and rights to use intellectual property objects. The document also applies to relations related to the rights and interests of third parties that are not users, but whose rights and interests may be violated as a result of the actions of the Users of the Revizion service.
For the purposes of these Terms and Conditions, terms and definitions shall apply as follows: Revizion is the first independent European website that evaluates the quality of service. This is certainly important both for companies selling goods and providing services and for consumers using these services and goods. The system collects real feedback, on the basis of which you can analyze and make your service even better and increase the loyalty of your customers. If you receive a negative feedback, you will immediately be informed by e-mail with the consumer's assessment and contact data for a more detailed analysis of the situation and further elimination. The Internet service contains a software and hardware part interacting with content databases, which allows you to receive information about customer feedback in a form convenient for perception, as well as analyze information, participate in content content and communication, as well as order additional services. The service is located on the Internet at: https://revizion.pro. Client - by Clients, in plural, should be understood any legal or natural person, information about which is posted on the site. Revizion Administration - Revizion Administration means authorized persons of Trade House Ukraine LLC registered under the legislation of Latvia and entered in the Unified State Register of Legal Entities, Individual Entrepreneurs and Public Formations by number 40203246411. Content - information content of the Revizion service, consisting of photo, video, audio materials, illustrations, literary and other works, including articles and publications, reference information and other intellectual property objects. User means any person who has accepted these Terms and has started using the Revizion service, including unregistered visitors. Services - for the purposes of these Terms and Conditions, Services shall mean services, works and goods supplied by Customers.
The Revizion Administration shall provide the Internet User (the "User") with the possibility of using the Revizion on the terms set forth in this user document (the "Conditions"). The Terms and Conditions shall become effective upon confirmation by the User of consent by registration or upon commencement of use by the Revizion Functions. The provision of the right to use the Revizion may not be regarded as the provision by the Revizion Administration of information or other services, joint activities relations, personal employment relations or other contractual relations provided for by law, unless such services are expressly provided for by this agreement. Any relationship between the Revizion Administration and the User may arise from a separate agreement, the terms of which are determined by the parties. The relationship between the Revizion Administration and the User shall be regarded as an Untitled Contract for the Free Use of Revizion Content, which shall be regulated solely in accordance with these Terms and applicable intellectual property law. The provision of content should be regarded solely as a form of publication of works. The use of the Revizion functions is free, with the exception of functions, the payment of which the User will be notified additionally. Therefore, the Customer-User relationship shall not be subject to the consumer protection rules of the European Union. The Revizion is a recommendation network that provides information (description, services, prices, feedback, etc.) in the European Union. The Revizion is a reference and information system in the understanding of the current legislation of the European Union. All information presented on the site is exclusively advisory and may include advertising or other materials designed to create interest in the Client's services. The information on the site is not official, should not be regarded as a public offer, offer or other form of expression of the will of the Revizion Administration or third parties to provide services on the terms set forth on the site. The content of the Revizion is collected by the Administration in accordance with the current legislation of the European Union on information and advertising. The information is relevant only at the time of its formation. The Revizion Administration shall not be responsible for updating information or for non-conformity of prices, list or quality of services and other information. Using any function of the Revizion Service or having passed the registration procedure, the User is considered to have accepted the Terms in full, without any reservations and exceptions. In case of User's disagreement with any provision of the Agreement, User shall not be entitled to use the Revizion service. If the Revizion Administration makes changes to the Terms and Conditions in the manner with which the User does not agree, it shall cease using the Revizion Service.
After the conclusion of a separate agreement, the Revizion Administration shall place the information of the Clients on the terms specified in the separate agreement. The search for information about the Client's establishments is carried out on behalf of the User, after providing the information necessary to search for the institution. After providing the User with information on the possibilities of providing the selected services, the Revizion Administration shall be deemed to have fulfilled all obligations to the User. Additional services shall be provided free of charge by the Revizion Administration, unless otherwise provided by the agreement between the Revizion Administration and the User. Additional services, if provided free of charge, are not subject to consumer protection legislation. The Revizion Administration has no responsibility for the quality and availability of the services searched by the User. The User independently selects one of the proposed Customer establishments and enters into a service agreement. The Revizion Administration is not a member of any relationship between the User and the Client that provides or undertakes to provide services. The Revizion Administration has the right without any explanation to refuse the User to provide services for the search of establishments.
The user has the right to use the Revizion "as is", that is, in the form in which it is presented on the site. The Revizion Administration reserves the right to make changes (delete, modify, supplement, limit, pay, etc.) to certain functions of the Revizion or the entire service without notifying the user of the planned change. Individual functions of the Revizion are provided to users only after the registration procedure with the creation of the Account of the User. Any use of the Revizion, which, in the opinion of the Revizion Administration, may harm the Revizion service itself (software or hardware parts), as well as the Revizion Administration or third parties, is prohibited. The Revizion Administration has the right at any time to restrict the use of the Revizion service without notifying users. The Revizion Administration also has the right to restrict the use of the Revizion Service or to deny access to the Service to individual Users if the actions of the users are qualified as an attempt to harm the Revizion Service, the Revizion Administration, other users or Clients. Any person using Revizion for commercial purposes without written consent of the Revizion Administration undertakes to pay to the Revizion Administration 1/4 of the profit received from such use. Users are prohibited from using obscene language; advertising and other information in order to attract interest in third-party resources; Publication of feedback and recommendations on institutions that they did not use or whose employees (affiliates) they are; use of feedback and comments forms for other purposes (for example, trolling, for advertising, etc.); use of Revizion content without the permission of Revizion Administration; posting Revizion content using frames and other technologies that allow the user to view content using third-party sites; duplication of the Revizion's content with reference to the source to the extent manifestly unjustified for the intended purpose; the use of technologies that block part of the Revizion content or the operation of the system as a whole. Users are forbidden to manipulate reviews to deliberately receive additional benefits from establishments. If the Revizion Administration finds such manipulation, such feedback may not be published at the discretion of the Revizion Administration. Only upon request of the user the Revizion Administration may not publish feedback. At the same time, the user must confirm his will by e-mail or by verified phone number or SMS message.
The Revizion administration is the owner of the domain name www.revizion.pro, as well as the exclusive owner of the rights to intellectual property objects presented on the site. The use of the Revizion content does not imply the transfer of intellectual property rights of the Revizion service, as well as objects of intellectual property rights that make up the content of the service or means of individualization of goods and services. The use of intellectual property rights objects and means of individualization presented on the site is possible only with the written consent of the Revizion Administration. Objects of intellectual property rights and means of individualization of goods and services used in the creation of information blocks belong to their rightful owners. The use in the Revizion of the means of individualization of the Client's establishments is exclusively informational in nature and is aimed at informing site visitors about the existence of the establishments and the means of individualization used by them. By posting on the site information or other objects of intellectual property rights, Users grant the Revizion Administration the exclusive right to use such objects, including, but not limited to, delete, edit, supplement, translate and adapt, transfer the right to use to third parties for a fee or free. The Revizion Administration shall have the right to control and verify the copyright infringement information provided by the User. The user agrees that all information provided to him, including internal correspondence using the functions of the Revizion, can be checked by employees of the Revizion Administration. In case of suspicion of copyright infringement by the User, the Revizion Administration shall provide all information about the User to persons whose rights, in the opinion of the Revizion Administration, have been violated. In case of violation by the User of rights and interests of third parties, the Revizion Administration shall have the right to make recourse claims to the User provided that the Revizion Administration compensates the consequences of such violation. The use of materials in whole or in part is allowed only with the written permission of the Revizion portal. To publish the Revizion materials with third-party resources, the following requirements should be observed: in the design of the article (the first paragraph), use a hyperlink to the full version of the material on the Revizion portal with the author of the material (editor of the Revizion portal); in the text of the article or after the material is completed, specify the original source using hyperlinks to the Revizion home page. The Revizion Administration reserves the right to refuse to place the material or make its adjustments to the conditions of placement. Written authorisation is valid within the time limit agreed by the parties.
The Revizion Administration shall take all necessary measures to ensure the confidentiality of the User and to preserve his personal information. The Revizion Administration shall not be responsible for the creation by Users of profiles indicating information that is publicly available. The User shall grant the Revizion Administration the right to use his personal data for identification in case of violation of the law or these Conditions. The Revizion Administration shall also have the right to provide the information specified in this paragraph to third parties, public authorities or other competent entities in accordance with the current legislation of the European Union. Accepting the terms of this Agreement, the User shall grant to the Revizion Administration the unlimited right to process its personal data received from the User or through exchange with third-party services, permission to process data on which was received from the User. Accepting the terms of this Agreement, the User agrees to process (transfer) personal data to third parties connected with the Revizion Administration by contractual relations, as well as to receive information and advertising messages from such third parties. The User agrees that the Revizion Administration is not obliged to notify the User of such processing (transfer). The User's personal data shall be processed by his consent in accordance with the requirements of the European Union legislation on personal data protection. The Revizion Administration has the right to send notifications to the User about the development and updating of the Revizion content.
Individual functions of the Revizion are provided only after registration on the site. Registration is carried out by the User voluntarily and independently by providing personal information necessary to create the account of the User. The user is obliged to provide exclusively complete and reliable information in accordance with the requirements on the registration page. If incorrect (incomplete or inaccurate) information is provided, the Revizion Administration shall have the right to require the User to provide complete and reliable information. If the Revizion Administration fails to comply with the requirements of the Audit Administration, the Revizion Administration shall have the right to block or delete the account of the User without prior notice. The Revizion Administration may require the User to confirm the information provided. In case of failure to confirm or refuse to confirm the information provided by the User, the Revizion Administration shall have the right to block or delete the account of the User. When registering, the User must select a unique symbolic account name (login) of the User and password to access the account. The Revizion administration has the right to refuse to register an account if the login or password does not meet security requirements or the login is already used by another user. The Revizion Administration has the right to control access to the Account of the User and to take measures in the form of temporary blocking and removal of the Account in case of suspicion of unauthorized access to the Account. At the request of the User or in case of violation by the User of any of the clauses of these Terms, the account of the User, including personal correspondence, comments, etc., will be removed from the Revizion database. The Revizion Administration reserves the right to keep the specified information in the form of backup copies of the database in case of conflict situations or requests for such information from third parties. The Revizion Administration shall not be liable for any moral damage caused to the information contained on the site unless the content of such information violates the existing legislation of the European Union.
Users bear full legal responsibility for any actions they have committed, including the placement of information or objects of intellectual property rights. For the purposes of these Terms and Conditions, the User's actions shall mean the personal actions of the User, as well as actions performed using the account of the User, computer or mobile device, which were used by the User to access the site of the Revizion service. The user is fully legally responsible for using his account, as well as providing access to the account (login and password) to third parties and undertakes to take all appropriate measures to prevent third parties from accessing his account. The Revizion Administration shall not be responsible for non-conformity of the Revizion Service to the needs or expected search relevance of the User. The Revizion Administration cannot guarantee the continuous, fast, reliable and error-free operation of the Revizion, as well as the quality of any service function, services, information, etc. obtained with the help of the Revizion. The Revizion Administration shall not be liable for any damage caused to the User by the use of the Revizion Service if such damage is not an offence under applicable law and is not intentionally caused by the Revizion Administration. The Revizion Administration is not responsible for the content of sites that were switched to when visiting links posted on the Revizion website. Access to the links posted on the Revizion website is carried out by the User at his own risk. The Revizion administration is not responsible for the morale of users when using the Revizion service, for the quality and cost of services provided by companies in information blocks.
All conflicts and disputes arising from the use of the Revizion service shall be settled peacefully through negotiations. In case of conflicts between users, the Revizion Administration reserves the right to evaluate the situation in accordance with these Conditions and to take measures in the form of blocking or deleting the user's account that violated these Conditions and the information provided to them. The Revizion Administration shall have the right to engage the User as a third party, witness or other participant in case of conflicts or disputes. All legal relations arising in connection with the use of the Revizion shall be interpreted by the relevant rules of the current legislation of the European Union, as well as by the customs of business turnover applicable to such legal relations, on the basis of the principles of good faith, wisdom and fairness. In case of violation of these Terms by the User, the User shall reimburse the Revizion Administration for the costs of legal assistance incurred in connection with such violation in full on the basis of contracts and accounts of persons providing legal services. The relevant expenses shall be reimbursed in court regardless of the procedural status of the Revizion Administration (plaintiff, defendant, third party, etc.). In case of violation of these Conditions, the Revizion Administration shall have the right to apply the specified measures of influence to the User regardless of the terms of such violation.
